These Terms of Use (“Terms”) govern your access to and use of the Backstory application, website, accounts, subscriptions, software, and related services collectively referred to as the “Services.”

The Services are provided by My Backstory, LLC (“Backstory,” “we,” “our,” or “us”).

By downloading or installing the Backstory application, creating an account, purchasing a subscription, accessing our website, or otherwise using the Services, you agree to these Terms and our Privacy Policy.

If you do not agree to these Terms, do not use the Services.

1. Our Principles

Backstory is built around several basic principles:

Your personal history belongs to you.
Backstory does not claim ownership of your information.
You decide which supported sources Backstory may access.
You decide what information to export or share with an AI provider.
Personal Content should be processed locally whenever the applicable feature is designed to operate locally.
Privacy is part of the product, not merely a legal obligation.

The remainder of these Terms describes the legal relationship between you and Backstory. It does not change these principles.

2. Description of the Services

Backstory helps you prepare information from sources you select so that ChatGPT and other AI tools can better understand your history, relationships, preferences, activities, and context.

Depending on the features available to you, Backstory may allow you to:

authorize access to supported sources;
process information locally on your device;
index, organize, search, or structure source information;
generate compiled context and source-grounded records;
review information before using it;
export information in supported formats;
make selected context available to an AI tool or other destination; and
maintain prepared context as your authorized sources change.

Backstory is not itself a general-purpose AI model. It prepares information for use with tools and services selected by you.

Features, supported sources, integrations, limits, and availability may vary by product version, device, operating system, subscription plan, or geographic region.

3. What Backstory Is Not

Unless we expressly state otherwise, Backstory is not:

a backup or archival service;
a permanent cloud-storage service;
a messaging or email provider;
an emergency service;
a records custodian;
a replacement for your original data sources;
a substitute for professional legal, medical, financial, tax, mental-health, or other advice; or
responsible for the accuracy of an AI provider’s output.

You should preserve original records and maintain separate backups of information that is important to you.

4. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to create a Backstory account or purchase a subscription.

By using the Services, you represent and warrant that:

you meet these eligibility requirements;
the information you provide to us is accurate;
you have authority to agree to these Terms;
you will use the Services in compliance with applicable law; and
you have the rights or lawful authority necessary to access and process the sources you authorize Backstory to use.

The Services are not directed to children under 13. A child under 13 may not create or independently operate a Backstory account.

5. Your Account

Some features may require a Backstory account.

You are responsible for:

maintaining accurate account information;
protecting your password, passkey, authentication credentials, and devices;
restricting unauthorized access to your account;
all activity that occurs through your account; and
promptly notifying us if you believe your account or credentials have been compromised.

You may not:

impersonate another person;
create an account using information you are not authorized to use;
transfer or sell your account;
share an account to evade applicable user or device limits; or
create multiple accounts to improperly obtain repeated trials, promotions, or subscription benefits.

We may require you to verify your identity, email address, payment method, or authority to act on behalf of an organization.

6. Source Access and Permissions

Backstory accesses only supported sources that you select and authorize.

Access may depend on:

operating-system permissions;
source-specific authorization;
file or database access;
credentials or tokens;
application settings; and
actions you take within Backstory.

You may revoke permissions through your operating system or disconnect a source through Backstory where that control is available.

Revoking a permission may prevent Backstory from continuing to update or use that source. It may not automatically delete:

information previously prepared from that source;
locally stored indexes or compiled context;
exports you created;
backups;
information transmitted to another service; or
copies stored outside Backstory.

You are responsible for reviewing and managing source permissions appropriate to your use.

7. Your Information and Content

7.1 Your Ownership

Backstory does not claim ownership of the information you authorize it to process.

You retain your rights in:

messages and attachments;
email;
documents and files;
notes;
contacts;
calendars;
photographs and media;
browser or application records;
information from other supported sources; and
other information you provide or authorize Backstory to access.

You also retain your rights in indexes, structured records, compiled context, exports, and other materials generated from your information, subject to any rights belonging to other people or third parties.

The original information and materials derived from it are collectively referred to in these Terms as “Personal Content.”

7.2 Limited permission to operate the Services

You grant Backstory a limited, non-exclusive permission to access, process, reproduce, format, transmit, and otherwise handle Personal Content only as reasonably necessary to:

perform actions you request;
operate features you enable;
provide customer support you request;
maintain security and prevent abuse;
comply with applicable law; and
enforce these Terms.

This permission does not transfer ownership of your Personal Content to Backstory.

It ends when no longer necessary to provide the applicable Services, subject to reasonable technical, backup, security, and legal-retention requirements described in our Privacy Policy.

7.3 Your responsibility for Personal Content

You are responsible for:

the sources you authorize;
the Personal Content you select;
the accuracy and appropriateness of your exports;
deciding what information to send to an AI provider;
ensuring that your use does not violate another person’s rights; and
complying with laws applicable to your processing or disclosure of information.

Backstory does not independently review every item of Personal Content or verify your authority to process it.

8. Information About Other People

Your authorized sources may contain information about other people, including family members, friends, colleagues, clients, correspondents, and children.

You represent and warrant that you have any rights, permissions, or other lawful authority required to:

permit Backstory to process that information;
create compiled context from it;
export it; and
disclose it to an AI provider or another destination.

Possessing a copy of information does not necessarily give you an unrestricted right to publish or disclose it.

You are responsible for applying appropriate judgment before sharing another person’s private, confidential, sensitive, privileged, proprietary, or legally protected information.

9. Local Processing

Backstory is designed to process Personal Content locally on your device when the applicable feature is described as local.

Local processing may include:

inspecting authorized sources;
indexing and organizing information;
creating structured records;
maintaining source references;
searching prepared context;
generating local summaries or compilations; and
producing exports.

Information processed locally may remain on your device unless you:

export it;
transmit it to another service;
enable a feature requiring external processing;
submit it in a support request; or
otherwise direct or authorize its disclosure.

Account, authentication, billing, application-update, website, support, security, and certain operational functions may require online services.

You are responsible for securing your device, operating-system account, local application data, backups, and exports.

10. Exports and AI Providers

Backstory may allow you to export Personal Content or make it available to ChatGPT, another AI provider, or another destination selected by you.

When you initiate or authorize such an action:

the selected information may leave your device;
the recipient’s terms and privacy practices apply;
the recipient may store or use the information independently;
the recipient may produce inaccurate, incomplete, misleading, or inappropriate output; and
Backstory cannot control the recipient’s subsequent use, retention, security, disclosure, model-training practices, or deletion of the information.

You are responsible for:

reviewing the information before transmission;
choosing an appropriate destination;
configuring the destination’s privacy and retention settings;
evaluating resulting AI output; and
determining whether the information or output is suitable for a particular purpose.

Deleting information from Backstory does not delete copies already transmitted to another provider.

Backstory is not responsible for decisions or actions taken in reliance on third-party AI output.

11. Subscriptions and Paid Services

Some Services require a paid subscription or other payment.

The price, billing interval, included features, trial terms, renewal terms, and applicable limits will be presented before purchase.

Unless otherwise expressly stated at checkout:

subscriptions renew automatically for successive billing periods;
your payment method will be charged at the start of each billing period;
subscription fees are charged in advance;
applicable taxes may be added;
your subscription continues until canceled; and
cancellation stops future renewals but does not ordinarily refund charges already incurred.

The offer and terms shown at checkout control if they differ from a general description elsewhere in the Services.

12. Trials and Promotions

Backstory may offer a free trial, introductory price, promotional period, or other limited offer.

The duration, included access, price after the promotional period, and other material terms will be presented when you enroll.

A trial may automatically convert to a paid subscription unless you cancel before the trial ends.

Unless otherwise stated:

each person may receive only one trial or introductory offer;
eligibility may be based on account, household, device, payment method, or other reasonable indicators;
promotional offers may not be combined;
trials have no cash value;
creating multiple accounts to obtain additional trials is prohibited; and
we may refuse, revoke, or limit a promotional offer in cases of suspected fraud or abuse.

Backstory may change or discontinue a trial or promotion prospectively. Changes will not alter the material terms of a trial you have already accepted unless permitted by law.

13. Automatic Renewal and Cancellation

Before enrolling you in an automatically renewing subscription, we will present the material subscription terms, including the recurring price and billing frequency.

By completing the purchase, you authorize the applicable payment provider to charge the disclosed recurring amount until you cancel.

You may cancel through the method identified at checkout, in your account, through the payment provider, or through the application marketplace where you purchased the subscription.

Cancellation takes effect at the end of the current paid billing period unless otherwise stated or required by law. You may generally continue using paid features until that period ends.

Deleting the application or ceasing to use it does not necessarily cancel a subscription.

If you purchased through Apple or another application marketplace, you must ordinarily manage cancellation through that marketplace, and its billing and refund rules may apply.

14. Price and Service Changes

We may change subscription prices, included features, usage limits, or plan structures.

A price increase for an existing subscription will apply no earlier than your next renewal after any notice required by law or the applicable payment provider.

You may cancel before the new price takes effect.

We may add, modify, limit, or discontinue free features at any time, subject to applicable law.

15. Refunds

Except where required by law or expressly stated in an applicable offer, subscription charges are nonrefundable.

We may issue refunds or credits at our discretion. Issuing a refund or credit in one instance does not obligate us to do so in another.

Purchases made through Apple or another application marketplace may be subject to that marketplace’s refund process and policies.

Nothing in these Terms limits any non-waivable refund or cancellation rights provided by applicable law.

16. Acceptable Use

You may use the Services only for lawful purposes and in accordance with these Terms.

You may not use the Services to:

violate applicable law or regulation;
infringe, misappropriate, or violate another person’s rights;
access information without authorization;
stalk, harass, threaten, exploit, or harm another person;
commit or facilitate fraud, identity theft, or deception;
distribute malware or malicious code;
compromise the confidentiality, integrity, or availability of a system;
gain unauthorized access to an account, device, network, source, or service;
evade technical, subscription, account, or usage restrictions;
obtain repeated trials through deceptive means;
interfere with or disrupt the Services;
overload or abuse our infrastructure;
probe, scan, or test a vulnerability without written authorization;
remove or alter proprietary notices;
use the Services to create a competing product through unauthorized extraction or copying; or
assist another person in doing any of the above.

You also may not use Personal Content prepared through Backstory in a way that violates law, confidentiality obligations, intellectual-property rights, privacy rights, or contractual restrictions.

17. Automated Access

You may not use bots, scrapers, automated agents, or similar systems to access Backstory-operated online Services except:

through an interface expressly provided for that purpose;
as permitted by applicable documentation; or
with our written authorization.

This restriction does not prohibit ordinary automation performed locally through documented Backstory features.

18. Reverse Engineering and Interoperability

You may not copy, modify, translate, reverse engineer, decompile, disassemble, derive source code from, or attempt to circumvent protections in the Services, except:

to the limited extent such a restriction is prohibited by applicable law;
where applicable law expressly permits the activity for interoperability; or
with our written permission.

You may not use information obtained through permitted reverse engineering for any purpose beyond the scope allowed by law.

19. Backstory’s Intellectual Property

Backstory and its licensors retain all rights, title, and interest in the Services, including:

software and source code;
application interfaces;
website content;
product design;
workflows and functionality;
documentation;
trademarks;
trade names;
logos;
graphics; and
other intellectual property.

Subject to these Terms, Backstory grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to install and use the application on devices you own or control for your own lawful use.

These Terms do not grant you any ownership interest in Backstory or the Services.

20. Third-Party Software and Services

The Services may use, include, interact with, or link to third-party software, open-source software, data sources, websites, services, or integrations.

Third-party components may be governed by separate terms or licenses.

Backstory is not responsible for:

third-party services;
changes to third-party APIs or operating systems;
third-party availability or security;
content supplied by third parties;
actions taken by an AI provider;
application-marketplace decisions; or
loss of functionality resulting from a third party’s changes.

A reference or link to a third-party product does not necessarily constitute endorsement.

21. Software Updates

We may provide patches, upgrades, new versions, security updates, or other modifications to the application.

Updates may:

add or remove features;
change compatibility requirements;
modify supported sources;
correct defects;
address security issues; or
be required for continued access to online Services.

Unless accompanied by separate terms, updates are part of the Services and governed by these Terms.

You are responsible for maintaining a supported operating system and installing required updates within a reasonable period.

22. Beta and Preview Features

We may identify certain features, builds, sources, or integrations as beta, preview, experimental, prerelease, evaluation, or similar terms.

Such features may:

be incomplete;
contain defects;
change materially;
produce incomplete or inaccurate results;
have limited support;
be subject to additional terms; or
be discontinued without becoming generally available.

You should not rely on beta or preview features for critical, irreplaceable, or production-dependent uses.

Any confidentiality obligation applying to a private preview will be communicated separately.

23. Feedback

You may choose to provide suggestions, ideas, bug reports, feature requests, or other feedback.

You grant Backstory a perpetual, irrevocable, worldwide, royalty-free, transferable, and sublicensable right to use, reproduce, modify, commercialize, and otherwise act on that feedback without restriction or compensation.

This permission applies only to the feedback itself. It does not transfer ownership of your Personal Content.

Do not submit feedback containing information you do not have the right to disclose.

24. Privacy

Our Privacy Policy explains how we collect, use, disclose, and retain information in connection with the Services.

The Privacy Policy is incorporated into these Terms by reference.

If there is a conflict between these Terms and the Privacy Policy concerning our treatment of personal information, the Privacy Policy controls.

25. Security

We use reasonable safeguards designed to protect information processed through Backstory-operated systems.

No software, device, network, storage system, or method of transmission is completely secure.

You are responsible for:

securing your devices;
using appropriate device encryption and authentication;
maintaining backups of important original information;
protecting exports;
securing connected accounts; and
promptly installing relevant security updates.

You must promptly notify us if you discover a vulnerability or believe your account has been compromised. You may not publicly disclose a vulnerability before giving us a reasonable opportunity to investigate and address it, except where applicable law protects such disclosure.

26. Availability and Modifications

We work to provide reliable Services, but we do not guarantee that every feature will always be available, uninterrupted, secure, or error-free.

We may modify, suspend, limit, or discontinue all or part of the Services for reasons including:

maintenance;
product development;
security;
legal or regulatory requirements;
third-party changes;
technical limitations;
low usage;
abuse prevention; or
business necessity.

Where reasonably practicable, we will provide advance notice before discontinuing a material paid feature.

You are responsible for exporting any Personal Content you wish to preserve before your access ends.

27. Suspension and Termination by Backstory

We may restrict, suspend, or terminate your access if we reasonably believe:

you materially violated these Terms;
your account presents a security or fraud risk;
payment is overdue or reversed;
continued access may harm Backstory, another person, or a third party;
suspension is required by law or legal process;
your use threatens the operation of the Services; or
information supplied in connection with your account is materially false.

Where appropriate, we may provide notice and an opportunity to cure the issue.

We may act immediately where necessary to address security, fraud, unlawful conduct, harm, or legal requirements.

28. Termination by You

You may stop using the Services at any time.

You may cancel a subscription using the applicable cancellation method.

You may also request deletion of your Backstory account as described in our Privacy Policy.

Uninstalling the application does not necessarily:

cancel a subscription;
delete an online account;
delete locally stored exports;
remove backups; or
delete information previously sent to another provider.

29. Effect of Termination

When these Terms or your account terminate:

your license to use the Services ends;
you must stop using paid or account-based features to which you no longer have access;
outstanding payment obligations remain due;
locally stored Personal Content remains under your control unless deleted by the application or operating system; and
provisions that by their nature should survive will remain effective.

Surviving provisions include those concerning ownership, feedback, payment obligations, disclaimers, limitations of liability, indemnification, dispute resolution, and general legal terms.

30. No Professional Advice

Backstory may prepare Personal Content that an AI provider uses to generate responses about legal, medical, financial, tax, relationship, parenting, employment, or other consequential subjects.

Neither the Personal Content prepared by Backstory nor output generated by another provider constitutes professional advice from Backstory.

You are responsible for obtaining appropriate professional advice and independently verifying information before making consequential decisions.

31. No Guarantee of Completeness or Accuracy

Backstory depends on:

the sources you authorize;
the records available in those sources;
operating-system and provider APIs;
permissions;
source formats;
technical limitations;
your selections; and
third-party behavior.

Backstory does not guarantee that:

every record in a source can be accessed;
source history is complete;
every relationship or fact will be identified;
generated context will be accurate or exhaustive;
source systems will remain compatible;
every update will be detected immediately; or
an AI provider will interpret context correctly.

Backstory may describe the boundaries, dates, or sources it processed. You should evaluate those disclosures rather than assume that any compilation represents your complete history.

32. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

BACKSTORY DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF:

MERCHANTABILITY;
FITNESS FOR A PARTICULAR PURPOSE;
TITLE;
NON-INFRINGEMENT;
ACCURACY;
COMPLETENESS;
QUIET ENJOYMENT; AND
SYSTEM INTEGRATION.

BACKSTORY DOES NOT WARRANT THAT THE SERVICES WILL:

MEET EVERY REQUIREMENT;
OPERATE WITHOUT INTERRUPTION;
BE ERROR-FREE;
IDENTIFY OR CORRECT EVERY DEFECT;
PRESERVE EVERY RECORD;
REMAIN COMPATIBLE WITH EVERY SOURCE OR DEVICE; OR
PREVENT EVERY SECURITY INCIDENT OR LOSS.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES. IN THOSE JURISDICTIONS, THESE EXCLUSIONS APPLY ONLY TO THE MAXIMUM EXTENT PERMITTED BY LAW.

33. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BACKSTORY AND ITS MEMBERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY:

INDIRECT;
INCIDENTAL;
SPECIAL;
CONSEQUENTIAL;
EXEMPLARY; OR
PUNITIVE DAMAGES;

OR FOR ANY LOSS OF:

PROFITS;
REVENUE;
BUSINESS;
OPPORTUNITY;
GOODWILL;
USE;
DATA;
PERSONAL CONTENT; OR
EXPECTED SAVINGS;

ARISING OUT OF OR RELATING TO THE SERVICES, EVEN IF ADVISED THAT SUCH LOSS MAY OCCUR.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BACKSTORY’S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF:

THE AMOUNT YOU PAID DIRECTLY TO BACKSTORY FOR THE SERVICES DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR
$100.

THE LIMITATIONS IN THIS SECTION APPLY REGARDLESS OF THE FORM OF ACTION, INCLUDING CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, STATUTE, OR OTHERWISE.

THESE LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED.

34. Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Backstory and its members, officers, employees, contractors, affiliates, licensors, and service providers from third-party claims, damages, losses, liabilities, judgments, costs, and reasonable attorneys’ fees arising out of or relating to:

your unlawful or unauthorized use of the Services;
your material violation of these Terms;
your infringement or violation of another person’s rights;
Personal Content you process, export, or disclose without lawful authority;
your use of an AI provider or another third-party destination; or
fraud, willful misconduct, or gross negligence by you.

Backstory will provide reasonable notice of an indemnified claim and may control its defense and settlement. You may not settle a claim in a manner that admits fault by or imposes obligations on Backstory without our written consent.

This section may not apply to the extent prohibited by applicable consumer law.

35. Governing Law

These Terms and disputes arising out of or relating to them or the Services are governed by the laws of the State of Missouri, without regard to conflict-of-laws principles.

The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Nothing in these Terms deprives you of mandatory consumer protections that apply under the laws of your place of residence.

36. Venue

Unless applicable law requires otherwise, any legal proceeding arising out of or relating to these Terms or the Services must be brought in a state or federal court of competent jurisdiction located in Missouri.

You and Backstory consent to the personal jurisdiction of those courts.

Either party may bring an eligible individual action in small-claims court.

This section does not prevent either party from seeking temporary or injunctive relief in an appropriate court to protect intellectual-property rights, confidential information, systems, or security.

37. Export Controls and Sanctions

You may not access, use, export, re-export, or transfer the Services in violation of United States export-control, trade-sanctions, or import laws.

You represent that you are not:

located in a jurisdiction where use of the Services is prohibited by applicable law;
identified on a United States government restricted-party list; or
using the Services for a prohibited end use.

38. Apple and Application Marketplaces

If you obtain the application through Apple or another application marketplace:

these Terms are between you and Backstory, not the marketplace operator;
the marketplace operator is not responsible for providing or supporting the Services except as expressly required by its applicable terms;
your use is also subject to the marketplace’s applicable rules;
billing, cancellation, and refund requests may be administered by the marketplace;
your license is limited to devices and uses permitted by the marketplace’s rules; and
the marketplace operator and its subsidiaries may be third-party beneficiaries of provisions required by its applicable terms.

If an applicable marketplace term conflicts with these Terms, the marketplace term controls only to the extent necessary for distribution through that marketplace.

39. Changes to These Terms

We may update these Terms to reflect changes in:

the Services;
our business;
applicable law;
payment or distribution requirements;
security practices; or
third-party services.

When we update the Terms, we will revise the “Last updated” date.

If a change materially affects your rights or obligations, we will provide reasonable notice through an appropriate method, which may include:

email;
an in-application notice; or
a prominent website notice.

Unless a different period is stated, revised Terms become effective when posted.

Where required by law, we will request affirmative acceptance before materially revised Terms apply.

If you do not agree to revised Terms, you must stop using the Services and cancel any subscription before the change applies to you.

40. Notices

We may provide notices to you through:

the email address associated with your account;
the application;
the Services; or
our website.

You are responsible for keeping your contact information current.

Notices to Backstory must be sent using the contact information below unless these Terms specify another method.

41. Assignment

You may not assign or transfer these Terms or your account without our prior written consent.

We may assign these Terms in connection with a merger, acquisition, financing, reorganization, sale of assets, change of control, or transfer of the Services.

Any attempted assignment that violates this section is void.

42. No Waiver

A failure or delay by either party to enforce a provision of these Terms does not waive the right to enforce it later.

A waiver is effective only if made in writing by the party granting it.

43. Severability

If a court determines that a provision of these Terms is invalid or unenforceable, the provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in effect.

44. No Third-Party Beneficiaries

Except for application-marketplace operators where expressly provided, these Terms do not create rights enforceable by any third party.

45. Entire Agreement

These Terms, the Privacy Policy, any purchase terms presented at checkout, and any additional terms expressly applicable to a feature constitute the entire agreement between you and Backstory concerning the Services.
